Roger Clemens' Legal Team Seeks to Get Defamation Suit Dropped

Roger Clemens' lawyer argued that a defamation suit filed by his former friend and personal trainer Brian McNamee should be thrown out of court at a hearing in Brooklyn on Wednesday.

Rusty Hardin, Clemens' lead attorney, repeated many of the same assertions he has made in various filings in recent months, including saying the U.S. District Court for the Eastern District of New York doesn't have jurisdiction over Clemens, a Texas resident. McNamee, who said he supplied Clemens with steroids and human growth hormone, claims his earning potential has been hindered by Clemens' constant denials he used performance-enhancing drugs in the lawsuit filed last year.

U.S. District Judge Sterling Johnson Jr. didn't rule on Clemens' motion and will file an opinion at a later time. Clemens was not present at the hearing.

The hearing was the latest twist for Clemens, whose fight to clear his name began when baseball released the Mitchell Report nearly three years ago. Clemens has denied ever using performance-enhancing drugs and filed his own defamation suit against McNamee in Texas, a case that was dismissed earlier this summer.
